NON CME RECORDING: Session 2: Specific Illustrations of Risk Mitigation Using Informed Consent and Informed Refusal
Physicians’ failure to adequately document informed consent and informed refusal conversations in the medical record can weaken the defense of later malpractice lawsuits or licensing board complaints. During this presentation, physicians will learn risk management tips to optimize their informed consent and informed refusal discussions and documentation in three specific situations as follows:
- Using informed consent documentation to reduce liability exposure when prescribing medications with black box warnings;
- Optimizing informed refusal conversations and documentation when working with caregivers who struggle to adhere to physician treatment recommendations related to minor mental health issues; and
- Arizona's statutory informed consent requirements for minor mental health treatment.
At the conclusion of this activity, learners will be able to:
- Explain the concept of informed refusal
- Identify 3 strategies for strengthening informed consent and informed refusal conversations or documentation
- Explain Arizona's statutory informed consent requirements for minor mental health treatment
